Minutes of Adjourned September Monthly Meeting of Kilrush Town Council held on the 20th September 2006 at 4:00 p.m. in the Council Chamber, Town Hall, Kilrush

In Attendance:

  • Cllr. Stephen O'Gorman, Méara.

  • Comhairleoirí: Tom Prendeville, Deirdre Culligan, Colie Sweeney, Marian McMahon-Jones, Liam O'Looney, Tom Clyne, Christy O'Malley, Jack Fennell.

  • Mr. Leonard Cleary, A/Director of Service & Town Manager

  • Ms. Fiona Mooney, Town Clerk

  • Mr. Steve Lahiffe, Executive Engineer

  • Ms. Geraldine Quinn, Assistant Staff Officer.

Cllr. Sweeney proposed that the Standing Orders be suspended so that he could read a statement re. the Tesco An Bord Pleanala appeal, but this was not agreed and Cllr Sweeney said he would circulate his statement directly to the media. The mayor advised that the agenda would be the basis for meetings. He urged the members to re-read their Standing Orders.

  1. Adoption of Minutes of July Monthly Meeting of Kilrush Town Council held on the 6th July 2006 at 4:00 p.m. in the Vandeleur Centre.

    Cllr. McMahon-Jones requested an amendment to item numbers 7 and 11 of the minutes of the July meeting so that at item 7 – Kilrush Town Council Standing Orders, the exchange between Cllr Prendeville which had been reported in the press and related to parking bye-laws which were unconnected to standing orders, would be recorded in the minutes. Regarding item 11 – a notice of motion regarding traffic at the Gaelscoil, Cllr McMahon Jones asked for an amendment to the minutes to reflect that she had read out a letter about traffic at the Gaelscoil from the Garda Superintendent.

    The mayor confirmed that the town clerk would record the amendment requests.

    Cllr Culligan wished to comment on the July meeting and reportage thereon in the press, but as Cllr Culligan had not been present at the July meeting, this was not allowed.

  2. Adoption of Minutes of Special Meeting of Kilrush Town Council held on the 22nd August 2006 at 4:30 p.m.

    Amendments were noted to these minutes. The official minutes would record the sympathy extended to Cllr McMahon Jones and her husband and to Martin Pyne, Tommie’s father and all the extended family and friends upon their loss.

    The minutes would include Cllr O’Malley as having been present at the meeting.

    Thus amended, the minutes were adopted on the proposal of Cllr Prendeville and seconding of Cllr Clyne.

  3. Audit Report to the Mayor and Members for y/e 31st December 2005

    Ar Moladh Cllr. Prendeville cuidithe ag Cllr. O'Malley:

    The Statutory Audit Report for the year ended 31st December 2005 was duly adopted.

  4. Manager's report on Planning & Development Acts (part 8) – No. 1 St. Senan's Terrace.

    Ar Moladh Cllr. Sweeney cuidithe ag Cllr. Clyne:

    The Manager's report dated the 1st September 2006 on the proposed development at No. 1 St. Senan's Terrace in accordance with Part 8, Section 179, 3(b) of the Planning & Development Act 2000 was duly adopted.

    Cllr Sweeney wished to note that he had resigned from the Vandeleur Walled Garden Enterprises Ltd and the Multi-Agency.


  5. Manager's report on Planning & Development Acts (part 8) - Extension at Island View.

    Ar Moladh Cllr. O'Malley cuidithe ag Cllr. Clyne:

    The Manager's report dated the 1st September 2006 on the proposed development at No. 35 Island View in accordance with Part 8, Section 179, 3(b) of the Planning & Development Act 2000 was duly adopted.

    In the case of both items 4 and item 5, the members welcomed the developments.

  6. Ar Moladh Cllr. O'Looney cuidithe ag Cllr. O'Gorman:

    "That this Council would afford a civic reception to the crew of the western yacht club 'Spirit of Kilrush' yacht following their successful participation in the BMW Round Ireland Yacht Race and because of the positive publicity given to the town through their efforts."

    The members agreed unanimously to afford a civic reception to the crew of the western yacht club following their success in coming 2 nd in their class, in the BMW Round Ireland Yacht Race. It was felt that they should be commended for their great efforts and excellent initiative and also for their excellent choice of name for the yacht and the positive publicity it brought.

    It was agreed that Items 7 and 9 would be taken together.

  7. Ar Moladh Cllr. Fennell cuidithe ag Cllr. Prendeville:-

    "That this Council show much concern on the recent census."

  8. Ar Moladh Cllr. Prendeville cuidithe ag Cllr. Fennell:-

    "To ask the Manager to prepare an analysis of the vital statistical data relating to the Kilrush urban area gleaned from Census 2006 in order to allow this council to accurately plan for the provision of future economic and social policies and services."

    Following discussion, the elected members agreed that the census 2006 figures appear to be wrong, arising from various flaws in the system of census data gathering and analysis, and that the figures do not accurately reflect the reality on the ground, which was that the number of people in the Kilrush urban area was growing and increasing, and not reducing.

    It was unanimously agreed that the town clerk would apply to the Census Office for figures in the Kilrush urban area and that Michael Neylon of Clare County Council be asked to collate and analyse the figures as he would have expertise in this area. It was unanimously agreed that Michael Neylon be invited to attend the November monthly meeting to make a presentation to the members.

  9. Ar Moladh Cllr. Prendeville cuidithe ag Cllr. Clyne:-

    "To ask the Town Manager to put in train the procedures prescribed under the Planning and Development Act 2000 for the carrying out of a full review of the current Kilrush Town Development Plan."

    Cllr Prendeville said that the current Development Plan needs to be reviewed in full arising from unprecedented development and growth in the town.

    The town clerk advised the members that she was advised from Forward Planning Dept of Clare County Council that the full review of the Kilrush Development Plan 2002 will commence during October 2006.

  10. Ar Moladh Cllr. Prendeville cuidithe ag Cllr. O'Gorman:-

    "That this Council would consider mounting the bronze head bust of Captain Kennedy presented by Monsignor John O'Shea in the Millennium Park. Captain Kennedy was the Poor Law Inspector during the Great Famine and his heroic humanitarian service during the tragic human holocaust in this town is deserving of the highest civic recognition by this council."

    The elected members agreed to invite submissions from the public on possible locations in the town where the bronze head bust of Captain Kennedy could be mounted. A closing date for receipt of submissions was agreed upon as November 2006. The town clerk suggested that any technical requirements regarding displaying the piece of sculpture would be established to guide the location selection process.

  11. Correspondence

    The following correspondence was read and noted :
  • Letter dated 7th June 2006 from Boyle Town Council re Electoral Amendment Act 2002. It was proposed by Cllr. Fennell and seconded by Cllr. Clyne that this letter be supported.
  • Letter dated 4th July 2006 from Bernard Carroll.
  • Letter dated 10th July 2006 from Special Olympics Ireland re Torch Run.
  • Letter dated 25th July 2006 from Fermoy Town Council re waste tax.
  • Letter dated 25th July 2006 from Cashel Town Council re Annual Commemoration of the Irish Famine.
  • Letter dated 25th July 2006 from Cashel Town Council re driving licenses.
  • Letter dated 8th August 2006 from Edenderry Town Council re educational motoring.
  • Letter dated 8th August 2006 from Edenderry Town Council re funding for the upkeep of country roads.
  • Letter dated 8th August 2006 from Edenderry Town Council re loose chippings on roads.

Cllr. Prendeville requested the town clerk to check out the matter of the local history bursary which was agreed at a previous meeting.

The mayor advised the members that An Taoiseach, Mr. Bertie Ahern, will be at The Marina at 12:50 p.m. on Thursday 21st September and all members are invited.

Votes Of Sympathy

It was agreed that a vote of sympathy should issue to the following :

  • Michael Frawley, Gowerhass, Kilrush on the death of his mother Mrs. Mary Frawley.
  • Carmel Ryan, Nagle's Terrace, Kilrush on the death of her mother Mrs. Margaret Cook of St. Patrick's Terrace.
  • Seán Keating, Fierd, Cross, Kilbaha on the death of his brother Mr. Patrick Keating.

The meeting then concluded.
